[Comment]

This case involves the protection of color combination trademarks. During the case handling process, the law enforcement officers found that the overall appearance of the goods involved was that the "scrapers" at both ends of the slider were red, the "end caps" were green, and the "sides of the slider" were black. The law enforcement officers fully considered the particularity of the color combination trademark, combined with the trademark pattern and the trademark registration application instructions, and referred to the provisions of the then "Trademark Examination and Trial Standards" that "both trademarks are color combination trademarks. When the colors and arrangement of their combinations are the same or similar, they are determined to be the same or similar trademarks." It was determined that the color combination was similar to the color combination trademark of the trademark registrant in terms of arrangement, use position and overall visual effect, which was likely to cause confusion and constituted an infringement as stipulated in Article 57, Paragraph 3 of the Trademark Law.
